1. Introduction

2. Quotations and Agreements
PhilipFixIt provides a quoted cost for the job. Upon acceptance of the quotation, we agree to complete all specified work according to the conditions set out in this agreement.
3. Scheduling and Delays
We will endeavor to meet any requested installation or service date. In cases where unforeseen circumstances prevent this, neither party will incur liability for delays or cancellations. We will coordinate with you to set a new date if necessary.
4. Business Hours and Scope Changes
We will complete the quoted work during our normal operating hours (Monday-Friday 7:00 am – 10:00 pm; Saturday-Sunday 10:00 am – 10:00 pm). Any changes or additions to the scope of work requested by you will incur extra charges. If your delay or default affects the schedule, PhilipFixIt reserves the right to add reasonable charges for additional costs incurred.
5. Permits and Permissions
You are responsible for obtaining all necessary permits, including building regulations, planning permissions, and any consents from neighbors or mortgage lenders.
6. Tenant Obligations
If you are a tenant, you must secure your landlord’s permission before any work commences. PhilipFixIt assumes such permission has been granted and will not be liable for any issues arising from a failure to obtain it.
7. Site Access
You agree to provide reasonable access and necessary utility services (such as water and electricity) to facilitate the work at no extra cost to PhilipFixIt.
8. Hazardous Materials
The quoted price does not include the cost of removing hazardous materials, such as asbestos. If asbestos or similar hazards are found, work will halt until the site is safe. Removal can be arranged upon request for an additional fee.
9. Existing Faults
PhilipFixIt is not liable for existing faults or for faults arising after our work due to issues with your pre-existing systems. Additional charges may apply for engineer visits if faults unrelated to our installation/repairs arise.
10. System Conversions
We accept no responsibility for issues with existing systems or components (e.g., pipework, radiators, valves) affected by a conversion to a sealed system or power flushing. Any necessary repairs to these older systems will be charged according to our standard rates.
11. Property Decoration
Reasonable care will be taken during the job, but some minor damage to surrounding decorations may be unavoidable. Redecoration costs are the customer’s responsibility and are not included in the quoted price.
12. Insurance
PhilipFixIt employees and contractors are fully insured against loss or injury due to negligence.
13. Force Majeure
We are not liable for delays or failures to perform caused by events outside our control, such as extreme weather, accidents, utility failures, or actions by third parties.
14. Limitation of Liability
PhilipFixIt limits its liability for any loss or damage to foreseeable losses resulting directly from a breach of contract.
15. Property Damage Claims
We are liable only for property damage directly resulting from a breach, with damages limited to foreseeable consequences for incidents reported within a 24-month period.
16. Estimates vs. Fixed Prices
We shall provide you with a written estimate. For the avoidance of doubt, a written estimate is not a fixed-price quotation; it is a likely estimate of the costs based on the information made available to us at the time.
17. Revisions to Estimates
We reserve the right to revise any estimate in the following circumstances:
17.1. You change your instructions and/or the scope of the work required.
17.2. There are unforeseen circumstances and/or the works become unduly complicated or protracted.
17.3. Further works are required to carry out your original instructions securely.
17.4. There is an increase in the price of materials and/or any tax or duties payable on materials that we will supply to you.
18. Estimate Expiration
Any estimate issued by PhilipFixIt will automatically be withdrawn unless accepted by you within 6 days of the date of issue.
19. Additional Works
If, during the course of the project, additional works are required, we will provide you with a revised estimate and will only carry out such works upon your written acceptance. We reserve the right to request payment on account for such additional works.
20. Acceptance of Quotation
Acceptance of any quotation or estimate must be confirmed by email to contact@philipfixit.com.
21. Custom Items and Cancellations
Custom or specially ordered items are non-refundable. If a project is cancelled within seven days of the scheduled start date, PhilipFixIt may still invoice for materials already ordered or prepared.
22. Payment Terms
Payments are accepted by BACS, cash, or cheque. Title to all goods and materials remains with PhilipFixIt until full payment is received.
23. Staged Payments
For larger projects requiring staged payments, invoices must be paid within seven days of each project stage’s completion.
24. Minor Defects
Customers may withhold a maximum of 5% of the total invoice or £100 (whichever is greater) for any minor, unresolved defects until they are rectified.
25. Final Settlement
Once any outstanding defects are resolved, the withheld amount must be paid in full immediately.
26. Late Payment Fees
Late payments will incur daily interest at 8% above the Bank of England base lending rate, along with any administrative fees resulting from returned payments or debt collection.
27. Invoicing
Invoices will be issued within seven days of project completion. Failure to pay may result in legal action.
28. Workmanship Guarantee
PhilipFixIt provides a two-year guarantee on our workmanship. This guarantee does not cover pre-existing materials (e.g., old radiators, pipework, valves) or damage caused by customer negligence.
29. Safekeeping of Goods
After materials are delivered to the property, the customer is responsible for their safekeeping and should ensure they are covered by adequate home insurance.
30. Transfer of Agreement
This agreement is personal to the client and is non-transferable without written approval from PhilipFixIt.
31. Cooling-Off Period
Upon acceptance of an order, you have a 14-day cooling-off period under standard consumer protection regulations. You may cancel the contract within 14 days by delivering written notice to us via email at contact@philipfixit.com. Please note: If you have explicitly requested that work commence before the end of this 14-day period, the right to cancel may be waived or you may be billed for work already completed.
